Lisa Abe-Oldenburg, Partner of Bennett Jones LLP, presented an overview of Canada’s new Anti-Spam Legislation which comes into force July 1, 2014. The new law affects all businesses in that it prohibits the sending of commercial electronic messages, altering of transmission data and the installation of software, without certain prescribed consent, informational and technical requirements. Prudent businesses should be well underway with preparations for compliance to avoid penalties of $10,000,000 per violation by corporations and $1,000,000 per violation by individuals, including directors’ and officers’ liability, once the Act comes into force.
